Services on PensionaNGuard are intended for individuals seeking legal information or consultation related to retirement matters. You must be able to enter into binding agreements under Malaysian law to access paid advisory services.
Age: Users must be adults under the laws applicable to their matters. Where representation is provided for a retiree by an authorized agent, documentation establishing the agent’s authority will be required.
Lawful Use: You agree to use PensionaNGuard services only for lawful purposes and not to engage in misuse such as submitting fraudulent documents or attempting to misrepresent identity in pension disputes or claims.
Country Limits: Certain services may be limited to residents of Malaysia or matters governed by Malaysian law. When cross-border issues arise we provide scenario-based guidance and may refer to local counsel in the relevant jurisdiction.
Account and Access
If you create an account to manage consultations, submit documents, or access a client portal, you are responsible for maintaining accurate account information and controlling access credentials.
Accuracy: Provide truthful information and update changes such as contact details, marital status, or appointment of executors so case records remain reliable for dispute or benefits processes.
Security: Protect your password and notify us immediately of suspected unauthorized access. We employ reasonable security measures, including encrypted connections for document uploads based on practical incident lessons.
No Transfer: Accounts are personal and may not be transferred without our written consent. Agents acting on a retiree’s behalf should provide proof of authority.
If you suspect your account has been compromised, notify support immediately and follow the verification process so we can take steps such as temporary suspension while contribute.
We may suspend access in specific circumstances such as suspected fraud, court order, or to comply with legal obligations. Where possible we provide notice and an explanation based on the case context.
Scope of Services
PensionaNGuard provides legal information, consultations, document review, and referrals tailored to retirees. Services include case evaluations, pension claim assistance, estate planning scenarios, and elder rights guidance based on practical examples and precedent where applicable.
Service Offerings may evolve. We describe changes with examples of how changes affect existing engagements (for example, new document types accepted for intake). We communicate changes with reasonable notice.
Availability: Scheduling and response times depend on caseload and complexity. We publish typical timelines and use case references so clients can plan hearings, appeals, or administrative deadlines accordingly.
User Conduct Rules
Users must follow rules designed to preserve safety, legality, and usefulness for retirees and their representatives. These are practical guidelines informed by common scenarios.
- Do not submit falsified documents or knowingly misleading information when seeking assistance for pension or benefits matters.
- Respect confidentiality of other users and do not attempt to access another user’s account or documents.

- When representing another, provide verifiable proof of authority such as power of attorney or court appointment.
- Comply with scheduled appointments and provide necessary documents promptly; delays can affect legal deadlines.
- Provide accurate contact details for service of notices and case communications.
- Cooperate with reasonable requests for clarification when we process rights requests or case-related inquiries.
User-Provided Content
Materials you upload or submit to PensionaNGuard (documents, case summaries, messages) are user content. We process them to provide legal information, consultation, and case management services.
Ownership: You retain ownership of documents you provide, subject to any third-party rights. By submitting content you represent you have the right to do so.
License: You grant PensionaNGuard a non-exclusive license to use, store and process submitted content to deliver services, respond to inquiries, and comply with legal obligations. This license is limited to purposes connected to your engagement.
Responsibility: You are responsible for the accuracy and lawfulness of content, including not uploading material that violates privacy, intellectual property, or court orders.
Removal: We may remove content that violates these Terms or applicable law. Requests for removal will be handled according to our privacy and retention procedures and relevant case needs.
Intellectual Property
Content created and published by PensionaNGuard, including guides, templates, and site content, is protected intellectual property. You may use materials for personal or client matters consistent with the usage rights we provide.
- Do not republish PensionaNGuard original guides or templates for commercial resale without written permission.
- Attribution: When sharing public guidance, retain attribution to PensionaNGuard as the source.
- Do not remove watermarks or copyright notices from downloadable materials.
Paid Services
Certain consultations, document drafting, and representation coordination are chargeable. Pricing reflects the scope and complexity of the legal task and is set out in engagement letters.
Pricing: We provide itemized estimates or fixed-fee quotes for common scenarios such as pension appeal bundles or basic will drafting. Case-based pricing examples are supplied to help clients compare options.
Payment: Fees are payable as stated in the engagement terms. Accepted methods include bank transfers and other payment options communicated during intake. Receipts are provided for each transaction.
Subscription: Some ongoing advisory services may be offered on a subscription basis with clearly defined deliverables and cancellation terms illustrated by scenario-based examples.
Refunds: Refunds, if applicable, are handled according to the stated engagement terms and the extent of work performed. For example, unrendered fixed-fee services may be partially refundable after administrative deductions where applicable.
Cancellation: Either party may cancel an engagement subject to notice requirements and settlement of outstanding fees related to work already performed.
Taxes: Applicable taxes will be added to fees where required by Malaysian tax law and are the responsibility of the client.
Price Changes: We will notify existing clients of fee changes with reasonable notice and explain how changes apply to ongoing engagements using case examples.
Non-Payment: Failure to pay may result in suspension of services and, for ongoing representation, potential withdrawal in accordance with professional conduct rules after notice is provided.

Limitation of Liability
To the extent permitted by law, PensionaNGuard is not liable for indirect losses arising from use of the site. Liability for direct losses is limited to fees paid for the relevant service, except where liability cannot be limited by applicable law. Third-Party Services

Termination

Consequences: On termination, access to the client portal may be removed. We will provide reasonable instructions for retrieval of client files and transfer to new counsel as applicable in real-world transition scenarios.
Privacy
Our privacy practices are described in the Privacy Policy. We process personal data to facilitate consultations, comply with legal obligations, and manage client relationships using safeguards and clear retention periods.
Communications
